This website, SpanishHomeInsurance.es (the "Website"), is owned and operated by Neil Peter Osborne, an individual insurance agent established in Spain, trading as 247 Expat Insurance and acting as an Exclusive Insurance Agent of Grupo Caser Helvetia.
Throughout these terms, "we", "us" and "our" refer to Neil Peter Osborne trading as 247 Expat Insurance. "You" and "your" refer to any person who visits the Website or engages our services.
These terms and conditions (the "Terms") govern your access to and use of the Website and any enquiry, quote or policy-placement service we provide through it. By using the Website or requesting a quote, you confirm that you have read, understood and accepted these Terms. If you do not accept these Terms, you must stop using the Website.
We operate as an exclusive insurance agent within the meaning of Royal Decree-Law 3/2020 of 4 February (transposing the EU Insurance Distribution Directive) and Law 20/2015 (LOSSEAR). This means:
The Website provides general information about Caser home insurance products, cover levels, buildings and contents sums insured, public liability, home assistance and related topics for English-speaking residents, non-residents and expats in Spain. We make reasonable efforts to keep the content accurate and up-to-date, but:
Any quote we provide is indicative and subject to confirmation of the information you supply (including the property's details, rebuild and contents values, occupancy and claims history), acceptance of your application by Caser, and any excess, exclusions or loadings Caser may apply on underwriting. Unless otherwise stated in writing, a quote is valid for 30 days from the date it is issued; after that the price may be re-quoted at current rates. Indicative "from" prices are not binding quotes — your actual premium is calculated individually by Caser based on factors including the property, its location, rebuild and contents values, occupancy and the cover selected.
To apply for a Caser policy through us, you must be at least 18 years old, provide accurate identity and property information, and accept Caser's underwriting decision. The contract of insurance is entered into between you and Caser, not between you and us. We facilitate and administer the application but are not a party to the policy.
Under Article 10 of Spanish Insurance Contract Law (Ley 50/1980), you have a legal duty to answer truthfully and completely all questions we or Caser put to you regarding the property, its use and your claims history. Providing inaccurate, incomplete or misleading information may allow Caser to reduce benefits, refuse a claim, or rescind the policy. If in doubt, disclose.
We provide information, quotes and distribution services. We do not provide regulated financial, legal or tax advice. Any general guidance we share regarding cover levels, sums insured or add-ons reflects the characteristics of Caser products and is not a personal recommendation tailored to your individual circumstances. Before you contract, we will supply the Insurance Product Information Document (IPID) and the contractual conditions so you can decide whether the product meets your needs and demands.
We are remunerated by commissions paid by Caser, included in the premium you pay. You do not pay us a separate fee for our distribution services. On request, we will provide more information about the nature and basis of the commission we receive in relation to your policy.
Premiums are paid directly to Caser by the payment method you authorise at the time of contracting (typically direct debit). Payment frequency, cancellation for non-payment and reinstatement are governed by the Caser policy conditions and Spanish insurance law. We do not handle or hold client premiums at any point.
For distance contracts you generally have a 14-day cooling-off period from the later of (a) the date you enter into the contract or (b) the date you receive the contractual documentation, during which you may withdraw without penalty (Article 10 of Law 22/2007 on distance marketing of financial services to consumers). Thereafter, cancellation is governed by your Caser policy conditions and applicable law — note that Spanish home insurance policies renew automatically unless cancelled with the required notice before the renewal date.
As an exclusive agent of Caser we recommend only Caser products; this is itself a potential structural conflict, which we disclose in advance. We maintain procedures to identify and prevent conflicts of interest from adversely affecting clients, and will disclose any conflict that cannot be managed before contracting so you can make an informed decision.
If you are dissatisfied with our service or a Caser product sold through us, you may complain in the first instance to us in writing at info@247expatinsurance.com (we aim to acknowledge within 5 working days and respond within 2 months); to Caser's Customer Service Department / Customer Ombudsman (Defensor del Cliente) as indicated in your policy schedule; or to the Complaints Service of the DGSFP once the insurer's internal process has been exhausted or two months have elapsed: www.dgsfp.mineco.gob.es.
All content on this Website — including text, articles, guides, layout, design, graphics, icons, logos, photographs, illustrations, images and source code — is the intellectual property of Neil Peter Osborne trading as 247 Expat Insurance, or is used under licence. Third-party trademarks (including the Caser and Helvetia logos and brand names) remain the property of their respective owners and are used solely to identify the products we distribute as an authorised exclusive agent.
You may view, browse and print individual pages of the Website solely for your own personal, non-commercial reference. No other use is permitted without our prior written consent.
Unless you have our express prior written authorisation, you must not: copy or reproduce any part of the Website for commercial purposes; redistribute or republish content to any third party; modify, adapt or create derivative works; frame or embed the Website within another site or application; mirror the Website; scrape, crawl or extract content or pricing data using automated tools; use our content in training datasets for artificial-intelligence or machine-learning systems without prior written agreement; remove or obscure any proprietary notices; or commercially exploit any content, including to create or market a competing product or service.
Any unauthorised use may infringe our intellectual-property rights and/or breach these Terms. We reserve the right to seek all available remedies, including injunctive relief and damages, under Spanish and EU law, including the Spanish Intellectual Property Act (Real Decreto Legislativo 1/1996).
When using the Website you agree not to submit false, misleading or fraudulent information; attempt to gain unauthorised access to any part of the Website or its systems; introduce viruses or malicious code; use automated means to harvest content or pricing; or use the Website in a way that breaches Spanish or EU law.
To the fullest extent permitted by law: we provide the Website on an "as is" basis and do not guarantee it will be uninterrupted or error-free; we are not liable for any loss arising from your reliance on general information on the Website (always check the Caser contractual documentation before contracting); and nothing in these Terms excludes liability that cannot legally be excluded, including for death or personal injury caused by negligence, or for fraud. As an exclusive agent who acts solely on behalf of Caser and never handles client money, liability arising from our distribution activity is covered by Caser under Article 26 of Royal Decree-Law 3/2020.
The Website may link to third-party sites, including Caser, the DGSFP and government portals. We do not control and are not responsible for the content, accuracy or privacy practices of those sites. Following external links is at your own risk.
We may update these Terms from time to time to reflect changes in law, regulation, products or our practices. The current version is always the one published on this page, with the "Last updated" date shown above. Continued use of the Website after changes are published constitutes acceptance of the updated Terms.
These Terms and any dispute arising from them or the use of the Website are governed by Spanish law. Subject to any mandatory consumer-protection rule granting you the right to bring proceedings in the courts of your place of residence, the parties submit to the exclusive jurisdiction of the Courts and Tribunals of Murcia, Spain.
